US Navy sailors sue Japan for radiation fraud - National Human Rights | Examiner.com

United States Navy sailors filed a lawsuit this week against the Japanese government for allegedly lying about the human right to health risks they faced assisting in rescue efforts after the 2011 Fukushima nuclear disaster.

For over a year, Japanese and American outrage about Fukushima disinformation and a lack of aid for people at risk from Fukushima fall-out, had seemingly fallen on deaf ears until the Navy's lawsuit.

Japan misrepresented radiation levels to lull US Navy 'into a false sense of security'

USS Ronald Reagan Navy crew members filed a lawsuit in Federal Court in San Diego, California this week to try to hold Japan accountable for long-term damage caused during “Operation Tomadachi,” the spring 2011 relief effort.

The operation sent sailors near Japan's coast to assist in days after an earthquake and tsunami ravaged the island nation, caused a level 7 meltdown at three reactors in the Fukushima Nuclear Power Plant, created thousands of energy refugees and left 300,000 Japanese children still being radiated daily.

The sailors allege a host of medical conditions, from headaches and difficulty concentrating to rectal bleeding and thyroid problems, as a result of the exposure and say they will have to undergo more medical tests and expensive treatments in the future, their lawyer Paul Garner said Thursday.

The sailors also want TEPCO, which has an office in Washington, D.C., to establish a $100 million fund to pay for any of their future medical expenses. (...)

The Japan Daily Press

US sailors sue TEPCO and Japanese government for lying about radiation risks - The Japan Daily Press

Eight U.S. Navy sailors have filed a lawsuit against the Japanese government and the Tokyo Electric Power Co. (TEPCO) for not disclosing to them the full extent of the situation and the risks involved as they were assisting in rescue efforts related to the Fukushima nuclear disaster last year.

The eight sailors were part of the more than 5,500 crew aboard the aircraft carrier USS Ronald Reagan who were part of “Operation Tomodachi”, a relief effort in 2011 that sent the sailors near the tsunami-ravaged coast of Japan.

According to the lawsuit filed in a Federal Court in San Diego, California, TEPCO, who owns the Fukushima reactors, misrepresented the radiation levels to lull the sailors into a false sense of security and rush into an unsafe area too close to the damaged nuclear plant. The plaintiffs also alleged that the Japanese government conspired with TEPCO, knowing that the information given out was incomplete and defective.

The sailors are demanding $10 million U.S. dollars for compensatory damages, $30 million U.S. dollars in punitive damages for fraud and negligence, as well as a $100 million fund for future medical expenses arising from the alleged radiation exposure.

Some people, however, hold a different opinion.

The USS Ronald Reagan was supposedly docked 100 miles away from the plant, which is far beyond the evacuation distance recommended not only by Japan but by the U.S. government as well.

Some media reported that the amount of radiation that the sailors were exposed to was less than that received from a month of exposure to background radiation from the sun.

Authorities failed to warn Japanese public about spread of radiation - The Japan Daily Press

A cabinet minister revealed on Tuesday that Japanese authorities did not share data from the United States that indicated radiation was spreading from the damaged Fukushima Daiichi nuclear plant last year.

The information originated from a U.S. military aircraft that had flown overhead, but once it was provided to the science and technology ministry, they just sat on it, claiming to be caught up in the chaos of the situation.

Not only was information not shared, but it directly led to some evacuees fleeing farther into radioactive areas, instead of away.

After the Fukushima plant was struck by the March 11th tsunami, the facility was unable to cool its reactors and suffered from explosions and an eventual meltdown.

The U.S. military gathered data from March 17th to the 19th, and found that some people were moving into areas around 25 kilometers (15 miles) northwest of the plant, and within eight hours were exposed to more radiation than is deemed “safe” for a period of one year.

This information was given to the Japanese Foreign Ministry, which in turn gave it to the Nuclear and Industrial Safety Agency (NISA) and the ministry of science and technology. From there is should have been evaluated and given to the prime minister’s office, as they were handling evacuations, but the information never made it that far.

The government has already admitted that due to “poor communication,” it did not disclose information from computer forecasts which predicted the direction radioactive emission would travel.

Yukio Edano, the Industry Minister, spoke at new conference and said that he truly regretted information this valuable was not used by the government or shared with the people of Japan.

However, Edano would not comment on whether any government employees would be fired or face criminal charges over the recent discovery.

US sailors sue Tokyo Electric Power Co. over radiation exposure | GlobalPost

Eight US sailors who helped deliver relief supplies to Japanese citizens following the tsunami and Fukushima nuclear power plant meltdown in Japan in 2011 are suing the Tokyo Electric Power Co. (TEPCO) for allegedly misleading the public about how much radiation was present in the area, the Marine Corps Times reported.

The sailors, who served on the aircraft carrier Ronald Reagan, filed a 36-page complaint in US District Court in San Diego last week, the Associated Press reported. They claim that TEPCO and the government of Japan

“conspired... to create an illusory impression that the extent of radiation that had leaked... was at levels that would not pose a threat to the plaintiffs,”

the Marine Corps Times reported.

The sailors charge that the Japanese government lied “through their teeth about the reactor meltdowns" so rescuers would "rush into an unsafe area,” the AP reported.

According to the AP:

They say they are at risk for developing cancer and a shorter life expectancy, and are undergoing considerable mental anguish as a result.

A female sailor’s infant daughter – who was in utero while her mother was deployed to Japan – is also a plaintiff in the case, the AP reported.

The group is seeking $40 million in compensatory and punitive damages for each plaintiff and access to a $100 million fund they can dip into if medical problems arise from their exposure to radiation, the Marine Corps Times reported.

Criminal probe into Fukushima nuclear accident begins - The Japan Daily Press

Fukushima Nuclear-Plant Plaintiffs comprising of more than 1300 residents have filed a complaint against executives of Tokyo Electric Power Co. including former Chairman Tsunehisa Katsumata.

Chairman Tsunehisa Katsumata

The Fukushima City prosecutor’s office has begun their criminal investigations based on the charges levied by the group.

They are to unearth the facts and investigate if professional negligence was also one of the reasons why the Fukushima Dai-Ichi plant went down the way it did.?

According to Ikuo Yasuda who represents the residents, the complaint includes

‘professional negligence resulting in bodily injury by radiation exposure and the death of hospital inpatients during transfer from Futaba Hospital.’

No doubt the Dai-Ichi plant disaster goes down as the worst civil nuclear-plant accident in the history of Japan.

What remains to be seen is if the residents will get the justice they seek. more

Nine workers are reported to have put lead shields on their radiation dosimeters to disguise their total exposure

Executive admits role in Fukushima radiation manipulation scandal

Tokyo Energy & Systems, a group firm of plant operator Tokyo Electric Power Co., has questioned employees at its Fukushima-based subcontractor Build-up.

An executive at Build-up allegedly made 12 lead covers and ordered employees to use them to lower the recorded exposure levels displayed on their dosimeters, according to Tokyo Energy & Systems.

A subcontract manager who told other Fukushima Daiichi workers that they should enter the plant with lead covers on the dosimeters, has confessed his role in the deception.  He made it clear the attempt of manipulation was aimed at falsifying exposure readings, saying, “If we’re exposed to levels close to the maximum, we won’t be able to get future work.”

“I came up with the idea to use covers because the dosimeters’ alarm repeatedly sounded” when he first entered the site, said Teruo Sagara, a director at Build-up, a subcontracting organization, during a press conference Monday at its office in Koriyama, Fukushima Prefecture.

“It was wrong,” Sagara, 54, said.

Three of the 10 workers whom Sagara confronted, refused to wear dosimeters with lead covers the following morning and then were excluded from the day’s work.  Sagara said that he refused to allow them to work as he did not know if he would be able to trust them to obey his instructions.

Now the Health, Labor, and Welfare Ministry has announced an investigation into the cover-up, with the goals of exposing any other flaws or indications of tampering related to radiological safety of the workers.

Per US NAVY authorized media promotional video of the mission. A fleet of 20 ships, 140 aircraft and 12,500 personnel were sent to assist in operation TOMODACHI. All ships and most all aircraft were contaminated. Many personnel were also exposed as we are finding out. The airborn squadron aircraft used in the relief missions had to stay behind after the carrier was smart enough to leave for home. The aircraft of that mission were just recently released and flew home to their home base after almost 2 years of decomtamination. The aircraft carrier Ronald Reagan has been docked since its return from Japan and is doubtful to return to service anytime soon if at all.

This information is good to have, but I would like to see a plan.

There is no plan.. Chernobyl was covered in concrete... that is not an option in Japan. Chernobyl's cover is getting old  It was designed to last 25 years  Its been up more than 50.  Fukushima is on the ocean...  tidal flows will keep sucking out that radiation

Just get used to new varieties of seafood :D

Chernobyl was in 1986 - that was only 27ish years ago...  I KNEW Chernobyl happened long after I was six years old (which was 50ish years ago)!

Why am I having a hard time understanding that the Navy had no equipment capable of reading the radiation and just blindly went in to a contaminated area? Even if they didn't know, shouldn't some alarms have gone off? Not even radiation tags?

Is ther something fishy going on here or am I missing something?   Deuem

More Vets Join Fukushima Lawsuit | Veterans Today

The Latest Pentagon Cover-up

By Dr Stuart Jeanne Bramhall

Quote
Navy vets Jaime Plym and Maurice Enis marked the second anniversary of the world’s worst nuclear disaster by joining the lawsuit filed by more than 100 sailors serving on the aircraft carrier USS Ronald Reagan immediately following the nuclear explosion in Fukushima on March 11, 2011. The Ronald Reagan was ordered to Fukushima from South Korea to provide humanitarian assistance to local residents affected by the devastating earthquake and tsunami.

The sailors delivering the assistance weren’t informed until after they were irradiated that there had also been nuclear explosions at three of Fukushima’s nuclear plants.

Clearly the sailors should have worn protective clothing and taken potassium iodide tablets for protection against I-131, a type of radioactive iodine that causes thyroid cancer.

It’s a great mystery why they didn’t.

All the ship’s officers were given iodide tablets, despite experiencing significantly less radiation exposure.

WTF ?

Quote
Predictably the vets who were nuked went on to develop serious medical problems. However they can’t sue the US government

because of a document their superiors ordered them to sign as a condition of their discharge. It releases the US government from any liability for medical problems linked to radiation sickness.

Sounds like the same carp as the Price Anderson Act for U.S. nukes exempting the industry from real damages in a law suit.   :P

We're mad as hell and not going to take it anymore.    >:(

Quote
Thus they are suing the Tokyo Electric Power Company (TEPCO), claiming the company hid the true risk of radiation exposure as the Navy provided relief to Fukushima residents. The original lawsuit against TEPCO was filed in December, but recently thirty plaintiffs have been added and a hundred more are in the process of joining.

Flynn and Enis told their story at the Fukushima Symposium at the New York Academy of Medicine on March 11-12. The event was cosponsored by the Helen Caldicott Foundation and Physicians for Social Responsibility.

As usual the full story didn’t make it into the corporate media. Since their discharge Flynn and Enis have no medical insurance, which makes it virtually impossible to access treatment for their conditions. In addition to suing TEPCO, they are also fighting to get their medical problems recognized as Service Connected to enable them to qualify for VA services.

The British Daily Mail has the most extensive coverage of the Fukushima lawsuit at Dozens of Vets Join Lawsuit and Two Navy Vets Join TEPCO lawsuit. However you can hear Flynn and Enis tell the whole story in their own words by watching their March 11th press conference at

The Broader Cover-Up

Quote
The sad saga of the Ronald Reagan is part of a broader cover up by TEPCO, the Japanese government, the Obama administration, the World Health Organization (WHO) and the International Commission for Radiological Protection (ICRP) of the long term health consequences of Fukushima.

Both Japan and North America have fairly large regions affected by radioactive fallout from the 2011 nuclear accident.

Instead of backtracking on the billions of dollars he approved to subsidize TEPCO to build more US nuclear power stations, Obama is participating in an international cover-up to conceal the serious long term dangers of this technology.

See After 50 Years Nuclear Power Still not Viable Without Subsidies

Quote
As part of the cover up, the Japanese government has launched a campaign to get residents to buy and eat food produced in and around Fukushima. They claim that after two years the radioactive contamination has nearly all dissipated. Fukushima Governor Yuuhei Sato claims Fukushima rice is totally safe provided it emits less than 100 Becquerels (Bq) per kilogram (kg). This directly contradicts decades of Chernobyl-related research linking Cesium-137 exposure to serious medical problems in Ukrainian and Belarusian children.

Following a nuclear accident,

Cesium-137 persists in the soil for a little over 100 years.

Governor promotes Fukushima rice at Tokyo supermarkets

24 November 2012

Quote
TOKYO —Fukushima Gov Yuuhei Sato visited supermarkets in Tokyo on Friday and Saturday in an attempt to convince shoppers that rice grown in his prefecture is safe.

The tour comes in the same month that rice production in the area restarts fully for the first time since the tsunami and ensuing nuclear disaster of 2011.

Sato brought radiation testing equipment and rice grown in Fukushima Prefecture to a supermarket in Edogawa Ward, Sankei Shimbun reported. He explained to shoppers, while testing samples of rice for radiation, that rice found to be emitting over 100 becquerels per kilogram would not be shipped to customers.

Sato also said that results of these radiation tests on a variety of produce would be published on a web page.

How convenient for those 100’s of thousands without web access.   :P

Quote
According to industry experts, crops last year failed to meet safety standards, which resulted in them being banned from sale in Japan. However, since that time, work has been done to remove from rice fields minerals that absorb large amounts of radiation.

As a result, local government officials say a higher proportion of Fukushima produce is now adhering to the government’s radiation guidelines and will be put on sale.

One would bet that the Japanese officials are not eating Fukushima produce.   :P
